                    SPECIAL COMMISSIONER’S SALE
Pursuant to Decree of the Circuit Court of Shenandoah County, Virginia, entered on the 29th day of August, 2017, in that certain Chancery Suit styled “Kemp L. Mumaw, et al. v. Bruce W. Mumaw, et al.,” Case No. CL17-120, the following real estate will be offeredfor sale to the highest bidder on SATURDAY, OCTOBER 28, 2017 AT  11:00 AM on site at 1107 Woods Chapel Road, New Market, Virginia 22844:


Two tracts of real estate located on the northwest side of State Route 826 (Woods
Chapel Road), described as follows:


TRACT ONE: (Tax Map No. 100 A 021) All that certain tract or parcel of real estate situate, lying and being in Lee Magisterial District, Shenandoah County, Virginia, and being more particularly described on that certain plat of survey prepared by James B. Walsh, Jr., Land Surveyor, dated September 11, 2017, as containing 117.626 acres, more or less.


The land consists of pasture ground, forest ground with some mature trees, tillable
ground, and is improved by a concrete silo, frame barn, equipment shed, two other
sheds, and a well. There is a pond located on this tract.


TRACT TWO: (Tax Map No. 100 A 017) All that certain piece, parcel or tract of real estate situate, lying and being about four miles southeast of Mt. Jackson, in Lee Magisterial District, Shenandoah County, Virginia, being more particularly described according to that certain survey prepared by James B. Walsh, Jr., Land Surveyor, dated August 20, 1993, recorded in the Clerk’s Office of the Circuit Court of Shenandoah County, Virginia, in Deed Book 694, Page 634, as containing 44.893 acres, more or less; LESS AND EXCEPTING therefrom that tract of 6.513 acres which was conveyed to Kemp Mumaw by deed from Arthur Mumaw dated the 5th day of November, 2002, recorded in the aforesaid Clerk’s Office in Deed Book 1014, Page 879.

The land consists of pasture ground and is improved by a barn.
There is a stream on both tracts, and both tracts are zoned A1 (Agriculture).


The aforesaid TRACT ONE and TRACT TWO were conveyed to Patricia A. DePoy, Gary A. Mumaw, Kemp L. Mumaw, Kim D. Mumaw, and Bruce W. Mumaw, by Deed of Gift dated the 3rd day of January, 2005, from Arthur S. Mumaw, recorded in the aforesaid Clerk’s Office in Deed Book 1182, Page 358.


For inspection by appointment call (540) 459-2113. Directions of the Property: From U. S. Route 11 (Old Valley Pike) south of Mt. Jackson, Virginia, take Smith Creek Road east to a left on Woods Chapel Road to farm entrance on left.


TERMS OF SALE: Bidder’s deposit of $25,000.00 will be required on the date of sale for TRACT ONE; $10,000.00 for TRACT TWO; and $35,000.00 for TRACT ONE and TRACT TWO, in the form of cash, certified or cashier’s check, with the balance due upon delivery of Deed within thirty (30) days of confirmation of the sale by the Shenandoah County Circuit Court. Conveyance is to be made by Special Warranty Deed. Real estate taxes will be prorated as of the date of settlement and delivery of Deed. The property will be sold in an “AS IS” condition, subject to all rights of way and easements of record. Sale to be made in gross and not by the acre and subject to confirmation by the Shenandoah County Circuit Court.


The real estate will be offered as separate tracts and then together as a whole. The highest bid received from whichever manner (separately or as a whole) will be submitted to the Court for confirmation. If the tracts are sold separately, TRACT TWO will be sold together with a 20-foot right of way over TRACT ONE as shown on the aforesaid August 20, 1993, survey, recorded in Deed Book 694, Page 634; and TRACT ONE will be conveyed subject to that certain 20-foot right of way as shown on plat of survey dated September 17, 2002, recorded in Deed Book 1014, Page 880.


A 5% buyer’s premium to be added to the last and highest bid at the auction to establishthe final sale price.
